Terms & Conditions

Welcome to Esther Luxe Safaris. By booking a safari, tour, or travel service with us, you agree to the following Terms & Conditions. Please read them carefully before confirming your booking.

1. Booking Confirmation

A booking is confirmed only after Esther Luxe Safaris has received the required deposit or full payment and issued a written booking confirmation. Reservations remain provisional until confirmation is provided.

2. Payment Terms

A deposit may be required to secure your reservation. The remaining balance must be paid by the due date stated in your booking confirmation. Failure to pay the balance on time may result in cancellation of the booking. Prices are quoted in the agreed currency unless otherwise stated.

3. Prices

All prices are based on current park fees, taxes, accommodation rates, transport costs, and exchange rates. Esther Luxe Safaris reserves the right to adjust prices before booking confirmation if these costs change. Once your booking is confirmed, the agreed price will remain valid unless government taxes or mandatory park fees increase.

4. Cancellations by the Client

All cancellations must be submitted in writing. Cancellation charges may apply as follows: More than 60 days before departure: Deposit may be refundable less administrative and supplier charges. 30–59 days before departure: Up to 50% of the total booking cost may be charged. 15–29 days before departure: Up to 75% of the total booking cost may be charged. 14 days or less before departure or no-show: Up to 100% of the total booking cost may be charged. Refunds are subject to the cancellation policies of hotels, lodges, airlines, parks, and other suppliers.

5. Changes to Bookings

Any requested changes after confirmation are subject to availability and may incur additional charges. Major itinerary changes requested by the client may require a revised quotation.

6. Cancellation by Esther Luxe Safaris

In rare circumstances, Esther Luxe Safaris may cancel or modify a tour due to circumstances beyond our control, including severe weather, safety concerns, government restrictions, or supplier issues. Where possible, an alternative tour or suitable refund will be offered.

7. Travel Documents

Guests are responsible for ensuring they possess: ● A valid passport. ● Any required visas. ● Health certificates or vaccinations. ● Any documents required by immigration authorities. Esther Luxe Safaris accepts no responsibility for travel disruptions resulting from incomplete documentation.

8. Travel Insurance

Comprehensive travel insurance is strongly recommended and should cover: Medical expenses. Emergency evacuation. Trip cancellation or interruption. Personal accidents. Loss of baggage and valuables.

9. Health & Fitness

Guests should ensure they are medically fit for safari travel and inform Esther Luxe Safaris of any medical conditions, allergies, dietary requirements, or mobility limitations before departure.

10. Wildlife & Safety

Wildlife lives in its natural habitat and sightings cannot be guaranteed. Guests must follow all instructions given by guides and drivers and comply with park regulations at all times. Esther Luxe Safaris is not responsible for injuries resulting from failure to follow safety instructions.

11. Client Responsibilities

Guests agree to: ● Respect wildlife and the environment. ● Follow guide instructions. ● Respect local cultures and communities. ● Avoid behaviour that endangers others. ● Be responsible for their personal belongings.

12. Accommodation & Transport

Hotels, lodges, camps, and vehicles are selected carefully. If circumstances require, Esther Luxe Safaris reserves the right to substitute accommodation or transport with a similar or higher standard without prior notice.

13. Liability

Esther Luxe Safaris acts as a tour operator and coordinates services provided by hotels, airlines, lodges, transport companies, and other suppliers. We are not liable for delays, cancellations, injuries, illness, loss, theft, accidents, natural disasters, political unrest, pandemics, or other events beyond our reasonable control.

14. Force Majeure

Esther Luxe Safaris shall not be liable for failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, floods, drought, epidemics, strikes, terrorism, civil unrest, government actions, border closures, or severe weather.

15. Photography & Marketing

Photos or videos taken during tours may be used by Esther Luxe Safaris for marketing purposes unless guests notify us in writing before the safari begins.

16. Privacy Policy

Personal information collected during the booking process will be used solely for arranging travel services, communicating with guests, and complying with legal obligations. We do not sell or share personal information except where necessary to provide booked services.

17. Complaints

Any complaint should be reported immediately to your safari guide or Esther Luxe Safaris representative to allow an opportunity for prompt resolution. Complaints submitted after the safari may limit our ability to investigate.

18. Governing Law

These Terms & Conditions are governed by the laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the Kenyan courts.
